Запобігання кіберзлочинності у порядку денному сучасних міжнародних відносин

Анотація

Метою дослідження був аналіз міжнародних правових механізмів боротьби з кіберзлочинністю та виявлення ефективних форматів взаємодії держав. У контексті глобальної цифрової трансформації та посилення транскордонних кіберзагроз системно проаналізовано міжнародне законодавство щодо протидії злочинам, взаємозвʼязки між різними елементами запобіжних механізмів. Статистичний аналіз даних 53 країн, в тому числі США, Німеччини, Франції, Польщі та України виявив зростання показників міжнародної взаємодії: кількість запитів про правову допомогу збільшилась з 245 у 2019 році до 689 у 2023 році, число спільних розслідувань зросло з 34 до 112, а кількість успішно розкритих справ підвищилась з 156 до 423. Обсяг відшкодованих збитків від кіберзлочинів збільшився з 23,5 до 89,4 млн доларів США. Найефективнішими визначено інструменти, запроваджені Директивами Європейського Союзу та механізмами НАТО, які демонструють вищу результативність порівняно з двосторонніми форматами. Встановлено, що 45 країнами досягнуто повної відповідності у визначенні складів кіберзлочинів, 38 – у процесуальних механізмах розслідування, 35 – у процедурах збору цифрових доказів. Кейс-аналіз виявив, що польсько-натівська співпраця скоротила час реагування на інциденти з 24 до 4 годин, українсько-ізраїльська взаємодія зменшила успішні втручання у критичну інфраструктуру на 39 %, а Трастовий фонд НАТО підвищив ефективність виявлення кібератак на 47 %. Для вдосконалення міжнародно- правових механізмів протидії кіберзлочинності рекомендовано гармонізувати національне законодавство країн у сфері процесуальних механізмів розслідування та збору цифрових доказів, розробити та імплементувати міжнародні стандарти регулювання ринку криптовалют, активізувати співробітництво з відстеження злочинних криптоактивів. Результати дослідження можуть бути використані для розробки національних стандартів та вдосконалення процесів міжнародної взаємодії щодо протидії кіберзлочинності
