Порушення адміністративного та кримінального законодавства як складова політичної діяльності

Анотація

Актуальність дослідження зумовлювалася зростанням ролі кримінально-правових механізмів у регулюванні політичних процесів та трансформацією категорії «політичний злочин» у міжнародному правопорядку. Метою роботи було дослідження еволюції поняття політичного злочину та виявлення моделей його правового переосмислення. Методологія ґрунтувалася на застосуванні історико-правового й порівняльно-правового аналізу для зіставлення правових режимів США, Туреччини та РФ, кейс-стаді та критичного дискурс-аналізу. У ході дослідження було встановлено, що класична доктрина політичного злочину, сформована в європейському праві XIX ст., виконувала функцію захисту політичної опозиції від переслідування, однак у другій половині XX ст. зазнала системної деградації. Виявлено, що після Другої світової війни міжнародне право відмовилося від універсального врахування політичного мотиву, замінивши його принципом персональної кримінальної відповідальності за міжнародні злочини. Доведено, що становлення міжнародного кримінального правосуддя призвело до істотного звуження сфери дії політичних імунітетів. Результати аналізу засвідчили, що у XXI ст. політичний злочин перестав функціонувати як автономна правова категорія та трансформувався у багаторівневий механізм правового регулювання політичної сфери. Встановлено, що в демократичних державах він використовується переважно для притягнення посадових осіб до відповідальності за корупцію, перевищення влади та зловживання повноваженнями. Натомість в авторитарних і гібридних режимах кримінальне право системно застосовується для криміналізації політичної діяльності, формування вибіркового правозастосування та нейтралізації опозиційних акторів. Проаналізовано поширення стратегій lawfare, за яких право використовується як інструмент політичної боротьби й делегітимації опонентів. Обґрунтовано, що міжнародне право переосмислює суверенітет не як абсолютний привілей, а як форму юридичної відповідальності держави, що розширює межі міжнародної юрисдикції та змінює правове становище вищих посадових осіб. Практичне значення дослідження полягає у можливості використання його результатів у науково-аналітичній та освітній діяльності, зокрема під час підготовки фахових правових висновків, аналітичних матеріалів і порівняльних оглядів у сфері міжнародного кримінального права
