Трансформація ідеї національного суверенітету в міжнародному праві після 2022 року: від Вестфальської моделі до Responsibility to Protect
Анотація
Метою дослідження було визначення ключових трансформацій концепції національного суверенітету в сучасному міжнародному праві під впливом геополітичних криз після 2022 р. Методологія поєднувала історико-правовий аналіз, порівняльний підхід і контент-аналіз міжнародних документів, що дозволило виявити закономірності у формуванні нової інтерпретації суверенітету. Результати показали, що традиційне уявлення про абсолютність державного суверенітету втратило практичну силу, поступаючись розумінню його як відносної категорії, тісно пов’язаної з відповідальністю держави перед населенням та міжнародною спільнотою. Порівняльний аналіз продемонстрував, що Вестфальська модель, яка акцентує на непорушності кордонів, виявилася неефективною для захисту цивільного населення, тоді як концепція Responsibility to Protect набула пріоритетного значення. Це підтверджено кейсами України, де агресія Росії актуалізувала механізми міжнародного кримінального права, а також ситуаціями в Газі та Кашмірі, що зосередили дискусії щодо гуманітарних інтервенцій та меж державного імунітету. Виявлено, що після 2022 р. концепція Responsibility to Protect отримала нові підтвердження у практиці міжнародних інституцій, зокрема через розгляд воєнних злочинів, геноциду та масових порушень прав людини. Аналіз показав, що хоча Вестфальська модель залишається основою міжнародного правопорядку, вона вже не здатна забезпечувати належний захист цивільного населення у глобальних кризах. Отримані результати засвідчили про формування змішаної моделі, у якій класичні принципи суверенітету співіснують із нормами гуманітарного права, орієнтованими на превенцію злочинів проти людяності. Практичне значення дослідження полягає у можливості використання його висновків для вдосконалення міжнародно-правових механізмів реагування на кризи, розробки стратегій захисту прав людини в умовах збройних конфліктів та адаптації зовнішньополітичних доктрин до нових глобальних реалій
