Гуманітарне право як простір конкуренції глобальних ідеологій: між універсалізмом і суверенізмом

Анотація

Метою дослідження було виявити, як ідеологічне протистояння між універсалізмом і суверенізмом впливає на ефективність міжнародного гуманітарного права у захисті цивільного населення. Порівняльно-правовим методом встановлено відмінності між універсалістською та сувереністською інтерпретаціями гуманітарних норм. Структурно-функціональний аналіз виявив амбівалентність Статуту Організації Об’єднаних Націй щодо прав людини та невтручання. Історичним методом простежено еволюцію Responsibility to Protect. Кейс-стаді Лівії, Сирії та М’янми показав селективність універсалізму та сувереністський опір через застереження, «м’яке право» та регіональні механізми. Дослідження виявило структурну амбівалентність Статуту Організації Об’єднаних Націй, який одночасно проголошує універсальні права людини та категорично забороняє втручання у внутрішні справи держав, що створює правову основу для вибіркової інтерпретації міжнародних норм. Аналіз практичного застосування доктрини відповідальності за захист продемонстрував фундаментальну селективність через контраст між військовим втручанням у Лівії та повною паралізацією щодо Сирії, де Росія заблокувала сімнадцять резолюцій з 2011 р., а російсько-китайське подвійне вето заблокувало передачу сирійської справи до Міжнародного кримінального суду попри підтримку тринадцяти з п’ятнадцяти членів Ради Безпеки. Систематизація інституційних механізмів обходу універсальних зобов’язань розкрила триступеневу архітектуру сувереністського опору через механізми застережень до міжнародних договорів, застосування м’якого права та створення регіональних альтернатив на прикладі Асоціації держав Південно-Східної Азії. Аналіз діяльності Асоціації продемонстрував, як принципи невтручання та консенсусного прийняття рішень фактично нейтралізують міжнародні стандарти, що проявилося під час геноциду рохінджа в М’янмі з переміщенням понад одного мільйона двохсот тис. людей при повному інституційному мовчанні комісії з прав людини Асоціації держав Південно-Східної Азії. Дослідження встановило, що ідеологічна конкуренція має багатовимірний характер і включає внутрішню фрагментацію універсалістської парадигми через появу альтернативних концепцій від бразильської відповідальності під час захисту до африканської не-байдужості
